"Desperate Housewives" creator Marc Cherry is asking the judge in the Nicollette Sheridan case to let his lawyers impeach the fired actress on grounds she has been inconsistent in her story that Marc violently hit her across the head during an argument.
Cherry admitted on the stand today his fingers came into contact with Nicollette's head but he denied violently hitting her.
According to new documents obtained by TMZ ... Cherry's lawyers want the jury to hear that Nicollette has changed her account ... originally alleging a slap and then escalating the allegation to a "violent hit." And during her testimony Nicollette changed her description yet again to a "nice wallop."
Cherry and his lawyers believe the inconsistencies prove Nicollette's battery claim is groundless.
As for what Cherry says he did ... in his testimony today he claims he was just demonstrating how a scene should unfold when his fingers made contact with Nicollette's head.

Lenny Dykstra -- No More Help From Charlie Sheen | TMZ.com
Financial disaster Lenny Dykstra is on a mission to raise enough cash to post bail -- hitting up Charlie Sheen and a bunch of other rich people he knows -- but so far, he's striking out big-time.
Sources connected to the former MLB great tell TMZ ... Lenny's people are scrambling behind the scenes to come up with $50,000 -- 10% of the $500,000 bail price -- so they can spring Lenny from an L.A. jail where he's been stewing since he was booked on 23 felony charges earlier this week.
We're told Dykstra's right-hand guy tried to set up a meeting with Lenny's pal Charlie Sheen -- who helped bail Lenny out of jail earlier this year -- but Charlie's assistant turned him away.
Lenny's people then approached two wealthy members of the Philadelphia sports community -- but they weren't willing to fork over any cash either.
Since they can't score a check, Lenny's people are now toying with the idea of throwing a celebrity fundraiser -- in the hopes some of Dykstra's friends like Darryl Strawberry, Dwight Gooden and Sheen will donate their time for the cause.
Meantime, Dykstra is scheduled to go in front of a judge today -- where he's expected to ask for a reduction in bail ... but with Lenny's history of legal trouble, we're guessing it ain't gonna happen.

The woman who claims a cocaine-possessing Brooke Mueller attacked her in Aspen last year tells TMZ she's not surprised Brooke wasn't sentenced to jail today ... saying, "Rich people get what they want and poor people don't."
TMZ broke the story ... Mueller struck a plea deal with prosecutors regarding the Dec. 2 incident ... in which she agreed to plead guilty to cocaine possession and in exchange the judge dismissed the misdemeanor assault charge and another coke charge. Brooke was only sentenced to 1 year probation.
Now, Brooke's alleged victim Llena Little tells us, "I knew this was going to happen ... I already prepared myself for Brooke not getting jail time."
Llena says she has no plans to sue over the alleged attack ... explaining, "It is what it is."

But we're told Fiddy actually jumped in to break things up when Ray J and Fab started scrapping.

Aretha Franklin canceled her scheduled appearance at Whitney Houston's funeral service in New Jersey yesterday afternoon ... but was well enough to perform at Radio City Music Hall that night.
Aretha said she had been suffering from leg spasms and wanted to rest up for her show, rather than travel for the funeral. She released a statement, saying in part, "heart goes out to my dear friend Cissy, Dionne, Bobbi Kristina and the rest of the family. May God keep them all."
The Queen of Soul dedicated a portion of her show to Whitney, and also to Nick Ashford, who passed away last August.

Mike "The Situation" Sorrentino is blanching at a lawsuit filed against him by his former manager ... claiming the manager was a slacker who actually did more harm than good.
TMZ obtained a statement from Richard Wolfe, Mike's lawyer, who says Gotham Management's suit "is filled with lies and falsities." Wolfe says Gotham, which is suing for $1 million in commissions, "did MORE HARM than good to Michael and his career."
The one thing the Situation and Gotham agree on is that Sitch is famous. Gotham claims in its suit it made him famous, and Wolfe says Mike's brother Marc Sorrentino "works tirelessly to build the brand that is Mike 'The Situation' Sorrentino."
Wolfe says Sitch will "pay Gotham what they are owed but no more."

Gallagher I'm Out of The Hospital AND I'M STILL FUNNY!!!
As we previously reported, Gallagher suffered a mild-to-serious heart attack before a show last week -- and was put into a medically-induced coma.
Just a few hours ago, the comic was finally cleared to leave the hospital ... but not before cracking a few jokes on his way out.
